A district court judge has denied, for now, a motion by Fall River city councilor Pam Laliberte to have two felony charges of witness intimidation dismissed.
Judge Sabine Coyne ruled that she could not issue an opinion on the motion to dismiss because Ms. Laliberte has not yet been arraigned.
Ms. Laliberte was charged this summer by Westport police with misdemeanor harassment of the wife of a former lover and felony witness intimidation in misleading the police investigation.
FRCMedia legal analyst Steven Sabra says the judge’s decision makes sense.
During a hearing on the motion last week, defense attorney Frank Camera invited attorneys for the Westport couple to publically state they were in approval of having the felony charges dropped.
Attorney Sabra says if the victims also want the felony charges dropped, the state may have a difficult time prosecuting the case.
Ms. Laliberte is due back in court on January 12. Attorney Sabra says there are implications for the defense if Ms. Laliberte is arraigned on that day.
