Former Fall River Mayor Jasiel Correia has been granted another delay to report to Federal prison.  The new reporting date is by noon Friday, March 4.

U.S. District Court Judge Douglas Woodlock approved the delay granting, in part, a motion by Correia’s attorneys this week to allow Correia to stay out of prison until they file briefs on Correia’s appeal to the U.S. First Circuit Court of Appeals.  Those briefs are due to the court by February 28.

Judge Woodlock denied, in part, the defense motion this week to stay Correia’s reporting to prison until after his appeal is heard based on a stay motion issued to a defendant in the “Varsity Blues” case also heard in Federal Court in Boston.

Judge Woodlock said both the prosecution and defense “must be prepared to pursue further action promptly” on the original defense motion to stay Correia’s report to prison filed last fall.

Correia was sentenced to six years in prison on his convicts last spring of fraud in relation to his SnoOwl app business and extortion in seeking money from prospective recreational marijuana vendors looking to open businesses in Fall River.

Judge Douglas P. Woodlock: ELECTRONIC ORDER re [388] Motion to Stay Surrender as to Jasiel F. Correia II (1) – GRANTING in part (for a further period no later than noon Friday, March 4, 2022, related to Defendants deferred filing of his February 28, 2022 opening brief to the United States Court of Appeals for the First Circuit, as to which that court has already warned that it is disinclined to grant a request for further enlargement… ) and DENYING in part (as to the suggestion that this courts disposition of the pending motion [328] for judgment of acquittal or new trial be formulated to be stayed indefinitely as was ordered in Abdelaziz matter). The parties must be prepared to pursue further action promptly regarding a stay of the disposition of the currently pending stay motion [328] adversely affecting that party. Cf. 1st Cir. Local Rule 9 (governing procedures for prompt resolution of release motions for recalcitrant witnesses).
